What Is The Process For Getting A Divorce?

The divorce process involves the following steps:

  • Filing for divorce

You can apply for a divorce by yourself or make a joint application with your spouse. The application must contain a statement declaring that your marriage has irretrievably broken down.

  • Responding to a divorce application

If your spouse has filed for divorce, you will be sent a copy of their application and have 14 days to confirm receipt with an ‘Acknowledgment of Service’ form. You can then go on to agree to the divorce or dispute it. Under the new divorce laws, you can only dispute a divorce in very limited circumstances such as if the English courts do not have jurisdiction.

  • Cooling off

Once a divorce application has been issued, there is a ‘cooling off’ period of 20 weeks. During this time, a couple can reflect on whether reconciliation might be possible or try to reach an agreement over issues such as financial settlements and where their children will live.

  • Conditional order

At the end of the cooling-off period, you can apply to the Court for a ‘Conditional Order’. This document does not mean that you are divorced, merely that the Court considers that you are entitled to a divorce.

  • Final Order

At least 6 weeks from the date of the Conditional Order, you can apply for a Final Order. This is the document which will legally end your marriage.
